The reply was not great
The reply was not great. All issues were run together an difficult to untangle what I needed to do. It actually made me more anxious. I don’t think that this is the right way to provide advice. It needs to be a human on the other end or I might as well feed my query into ChatGPT.

Disappointed with the request to use other than information I sent. Please remember that we are in our eighties and do not have modern techniques that you expect us to supply for the ease of a response. When finally received your response it was gratefully received but has left us both concerned that we need a solicitor and the cost. We thank you for you information which has been sent.

Part answered
The question I asked was answered but didn’t address my position as long leaseholder in regards to the landlords ownership of the upper property lease and using it as a HMO - rather than me contemplating HMO. I need to know if I have any protection as the HMO is causing drainage and other problems.

Enquiry about water damage to my flat
After month of trying to get some answers regarding ongoing leaks (3 in total) and sending a copy of my lease (I posted it lst Class) to the address on the email. I did this because I had suffered a stroke, the Leasehold Advisory Team never acknowledged receipt of it although I emailed to ask whether it had been received. So eventually I had a telephone consultation at 1pm 30/8/26 with At 1.10 I rang the number because I hadn’t heard from and it was not until 1.30 I managed to speak I had a copy of my lease and the legal adviser proceeded to ask what it said about damage, whether the council could enforce the leaseholder who had caused the damage under the insurance, to repair. It soon seemed to me that although I was insured it was being looked as accidental damage although I had suffered three leaks, previously I had a double glazed unit replace from the same leak a few years ago and in total I had suffered 8 leaks in 5 years since the leaseholder had lived there. I have lived in my property since 1989 been a leaseholder for 24 years and never had a leak from the previous leaseholder who lived above me for 26 years.
It is not only the fact that all of this has happened but the fact that then brought up the fact that there had been a court case in which I was charged with making a racial comment about my neighbour. I was given a conditional discharge over two years ago and may I add that I think I was innocent but the court did not allow any evidence from me to show that I had suffered four and a half years of antisocial behaviour from the leaseholder and her then partner. My solicitor presented little bit of evidence from a great deal of CCTV, photos, logs that I had over the years provided to the Police and the Council. It was not a balanced court hearing I considered to be one sided and I considered had not been racial, I am half Polish and all I said was the Polish people I was raised with would never treat anyone the way that they had treated me in the over the four years they had subjected me to their ASB. I was found guilty and told that I have not to have any contact with the leaseholder.
This also applied to the leaseholder
And this I have done. I suffered a stroke
but still got taken to court. I have nothing to do with the leaseholder but same cannot be said of her. I choose to ignore her even though she does things, she has a new partner and makes nasty comments when I walk past her, leave food rubbish on her garden and her children’s scooters to block the communal path.
So why I am relaying all of this? Because all I wanted was a reply as to whether I am insured, the damage could be repaired but along with this brought up that there had been a long running dispute between myself and the upstairs leaseholder and that there had been a court case for which I had been found guilty. I was told that if I were to sell my property I would have to declare it. Why, I went to court, the matter was dealt with (wrongly) but that was over two years ago and I have done what the court told me to do. I want to complain that firstly how did the Leasehold Advisory Service Advisiry know about this? The full circumstances of the court case and what happened before was not known and why was it necessary to discuss it when when I was trying to find out about damage to my flat . Who told Leasehold Advisory Service about it in the first place? This was a enquiry about a leak nothing more and then I was told Iwould have to declare antisocial behaviour if I wanted to sell my flat at any time. I do not have to declare this, I have not caused any antisocial behaviour, but I went to court because I was accused of racism and the matter was dealt with and the case closed. This is being tried all over again all because I wanted to find out about a leak. I will not be tried again and the Leasehold Advisory Service owe me an explanation
for the way they have handle my enquiry and the distress they have caused.
And where did they get there information and who gave them it and more to the point it has not been updated with the facts of the outcome of the court case

Email Response versus Discussion
I have dealt with the LAS on a number of occasions over many years. Having become fairly well versed in L & T Act law, related regulations and practice, the questions that I ask are not ones with a simple answer. On the recent occasion that I contacted LAS, it appeared that I could no longer book a telephonediscussion with an adviser and instead had to rely on putting my question in written form and receiving a reply by email - therefore by definition a narrow response, about which I needed further discussion. If the inability to schedule a call (as previously) is a permananet change, this is a highly retrograde step that will make the excellent service previously provided by the LAS far less effective and helpful for those requiring assistance.
