Having reviewed your case, I can see that the claim that was raised by your letting agent hasn't been finalised and no outcome has been made.

Your letting agent has received a claim assessment which was completed using the evidence that has been provided however as part of that assessment we give you a further opportunity to provide more evidence to dispute it.

Guarantee Issued, Guarantee Refused

Zero Deposit issued a Guarantee Certificate for my tenancy. When the tenants later accumulated substantial rent arrears, were evicted through the courts and a County Court Judgment was obtained, Zero Deposit refused to honour the guarantee.

Their reason? I could not provide a historic HomeLet reference report for one joint tenant—a document that was never in my possession or under my control. The referencing was completed by the letting agent before the tenancy began.

My question is simple:

If the required referencing had not been completed, why did Zero Deposit issue the Guarantee Certificate in the first place?

If the referencing was satisfactory when the guarantee was issued, how can the later unavailability of a document held by a third party suddenly invalidate the guarantee?

A guarantee is meaningless if it can be avoided on this basis years later.

I have repeatedly asked Zero Deposit to identify the contractual clause supporting this decision and to confirm whether the missing reference was reviewed before the Guarantee Certificate was issued. I have yet to receive a clear answer.

I invite Zero Deposit to respond publicly to these questions so that other landlords can understand what protection this scheme actually provides.

Please note that we have replied to your email directly.

Regarding the Guarantee certificate, as the referencing is completed by the landlord or the letting agent on their behalf, we will not receive a copy of the reference until their is a claim made against the guarantee.

Regarding the referencing itself and the validation of the guarantee, as per the terms of the guarantee that are sent to you at the start and throughout the guarantee, one of the minimum pieces of evidence we require for a claim to be successful is a copy of the reference document undertaken by yourself or the letting agent on your behalf. If for whatever reason you are unable to produce this document we will be unable to recommend the claim be paid.

While I appreciate this will be disappointing to read, without the reference as per the terms of the guarantee we are unable to recommend payment is released.
