Terrible company who have not started to threaten my wife with a bill even though after repeatedly telling Barings not to continue with her case because they asked for direct access to our bank account which no reasonable company would do.
She has repeatedly phoned and emailed but they ignored all requests to discontinue and are now starting to make threats, disgusting behaviour from this company.

For the first time since the Capita breach claim started I have become concerned. Yesterday I look in my spam email and it appears that an email from them and a subsequent one from Abbleys solicitors went there. I have now read them and it appears that my case has transferred to Abbleys and have been asked to sign a new agreement. Firstly, I am concerned that both went to my spam email and that I didn't have an opportunity to ask any questions prior to the transfer. Secondly after reading the new agreement, I am unclear as to whether there is a possibility that I could incur a net cost in the event of worst-case scenario given the new terms. I also don't know that if I asked for the case to not transfer and not continue whether that I could have just ended it there with no cost to me and parked the stress that this is generating (by fearing that there could be a net cost as a worst-case scenario). I try to avoid stress/anxiety and actively do so for health reasons. I have sent an email to Abbley's yesterday trying to get clarification on the new agreement. Barings - are you able shed any light on this please? I have put a two-star rating for now for this communication mishap. Today I have upgraded this to a 4 star in light of this response. I will look to contact Barings on this but am awaiting a response from Abbleys first to an email I sent them. For now I am happy with the response here from Barings and will update my review rating in due course if this is merited,

Sorely disappointed with these chancers.
Have been waiting eons for the Capita data breach claim to come to fruition.
Suddenly after the Judge's decision notes got posted they've washed their hands with it and a senior partner (with their blessing apparently) had without MY permission taken the case files to a new firm and today I get an email inviting me to sign a new agreement.
I got Claude AI to read the judgement and give a summary - surprise surprise both Barings botch job and Crapita have had their *rses handed to them on a silver server by the judge - Barings for being zealous with their terminology of client harm "traumatised" was one verb used and Crapita got a good kick in the balls for trying to get it thrown out.
Now Barings know they're not going to get top tier payouts for the breaches - claimants will be lucky VERY lucky to get 1k before fees and expenses, (if that) so guess what?
Everyone's going to be getting a cake and bus fare home. Well done Barings - Well done 🤬 now 💩 in your hands and clap you pathetic useless lot.

The case: Spurgeon & Ors v Capita plc [2026] EWHC 241 (KB), 9 February 2026
Around 4,000 claimants (represented by Barings Law) brought compensation claims following the 2023 Capita data breach, which exposed the personal data of 6.6 million people. Capita tried to have all the claims thrown out.
What Capita argued
Capita claimed Barings had committed an abuse of court process by "putting words into the claimants' mouths" — specifically using emotive language like "tormented," "violation of security," and "betrayal of trust" in the Particulars of Claim, words that hadn't come from the claimants themselves. Capita argued this had so tainted the evidence that all claims should be struck out.
What Master Dagnall decided
He refused to strike the claims out. His key reasoning was that pleadings are drafted by lawyers, not clients — they are not witness statements or evidence. Each claimant will still need to provide their own witness statement, and it's on that evidence the case will ultimately be decided. He found that Barings had done nothing wrong, and that solicitors have wide latitude in how they formulate a client's instructions into a pleading.
He did however express concern about some of the language — noting that words like "tormented" are vague and could mean anything from mild annoyance to serious mental anguish. His provisional view was that such language should be replaced with something more precise, like "varying degrees of substantial anxiety and distress." This will be resolved at a subsequent hearing.
What this means going forward
Capita essentially admitted that claimants may have genuine claims at some level, even if not necessarily at the £1,000 per person Barings is targeting. Now that the strike-out has failed, Capita faces a choice: contest each individual claim (very costly) or settle. On top of this, Capita was already fined £14 million by the ICO over the breach"
