Misrepresentation of Goods
Beginning in August 2025, I communicated with the merchant regarding the purchase of bar stools. During these discussions, I clearly and repeatedly stated that I would only purchase stools manufactured in Italy, and country of origin was a material condition of my buying decision.
The merchant represented that the stools being offered were made in Italy, and based on those representations I approved the charge on September 14, 2025.
The stools were scheduled to be delivered prior to Thanksgiving 2025; however, delivery was repeatedly delayed. Because delivery was not completed as promised, I ultimately drove to Orlando, Florida to pick up the stools myself. The merchant refunded the delivery charge at that time.
On December 11, 2025, after opening the sealed boxes at home, I discovered that the stools were manufactured in China, not Italy as represented. I immediately notified the merchant.
On January 3, 2026, the merchant acknowledged in writing that the stools were not made in Italy and agreed to issue a full refund. Despite this agreement, the merchant later attempted to impose a restocking fee and has refused to arrange reasonable pickup of the goods. The merchant is conditioning the refund on unreasonable return requirements, preventing completion of the refund process.
