I unfortunately raised a complaint because I felt that they disability discount was a discrimination concern in breach of the Equality Act 2010. To have a policy that only allows for a benefit to be applied to people who are in receipt of the higher level of disability benefit only, could be an act of indirect disability discrimination against disabled people, in line with the Equality Act 2010.
I urged the company to reconsider the policy by offering either a benefit which doesn’t exclude other disabled persons or remove the benefit entirely. For the policy to be lawful, you would need to show that this requirement is a 'proportionate means of achieving an legitimate aim' If a legitimate aim can be achieved by less discriminatory means the policy maybe then unlawful.
This was submitted on the 10th Sept. I’ve not yet had a response and as such I’m escalating it with citizen advice.
This is disappointing and unprofessional.
