Madame, Monsieur,
Par la présente, je vous adresse une mise en demeure formelle, accompagnée d’une lettre d’intention de poursuite, relativement à l’achat d’un bâton de hockey CCM Jetspeed XE Extra Senior XT90, effectué le 28 novembre dernier dans le cadre du Black Friday, au prix de 240 $, prix régulier affiché de 400 $.
### 1. Faits
- Le bâton a été acheté en ligne auprès du détaillant Sport Excellence.
- La livraison a nécessité un délai de deux semaines et demie avant réception.
- Le bâton a été utilisé une seule fois, le 22 décembre, dans des conditions normales d’utilisation.
- Dès cette première utilisation, un délaminage de la palette de carbone est apparu à l’extrémité du bâton, révélant un défaut manifeste de fabrication.
Le 23 décembre, j’ai communiqué avec Sport Excellence afin de signaler le problème et demander l’application de la garantie. Aucune réponse ne m’a été fournie avant le 16 janvier, soit plus de trois semaines plus tard. Ce n’est qu’à ce moment que l’on m’a dirigé vers CCM Canada pour une réclamation de garantie.
Or, CCM Canada m’a alors répondu que le délai de 30 jours pour une demande de garantie était échu, refusant ainsi toute prise en charge.
### 2. Impossibilité raisonnable d’exercer la garantie
Cette situation démontre une impossibilité réelle et objective pour le consommateur d’exercer ses droits, malgré une diligence raisonnable, en raison de :
- délais de livraison prolongés;
- utilisation raisonnable effectuée dès que les conditions l’ont permis;
- délai excessif de réponse du détaillant Sport Excellence;
- transfert tardif et inefficace vers le fabricant;
- refus final de garantie fondé uniquement sur un délai administratif incompatible avec la chaîne de distribution actuelle.
Un tel système rend pratiquement inapplicable toute garantie, ce qui constitue un manquement grave aux obligations prévues par la Loi sur la protection du consommateur du Québec, notamment quant à la qualité raisonnable du bien, sa durabilité normale, et l’accessibilité réelle au service de garantie.
### 3. Préjudice
Il est inacceptable qu’un bâton dont la valeur marchande est de 400 $ présente un défaut structurel après une seule utilisation, sans possibilité effective de recours. De plus, cette situation m’a occasionné :
- une perte financière directe;
- une perte de temps considérable;
- l’obligation de racheter un bâton équivalent auprès d’un autre fournisseur;
- des délais supplémentaires incompatibles avec une pratique sportive régulière.
### 4. Mise en demeure
En conséquence, je vous mets formellement en demeure, conjointement et solidairement (CCM Canada et Sport Excellence), de :
➡️ me rembourser intégralement le montant payé de 240 $,
➡️ dans un délai de dix (10) jours suivant la réception de la présente.
À défaut de quoi, je procéderai sans autre avis à une poursuite devant la Cour civile du Québec, incluant une réclamation pour :
- le coût du bien défectueux;
- les frais connexes;
- les dommages punitifs applicables;
- le temps perdu et les inconvénients subis.
La présente constitue une dernière tentative de règlement à l’amiable.

My son bought a new CCM stick up your hockey on December 2. He played two games and one practice and it snapped in half. He took it back to pure hockey and they sent him a new one. The new stick he used for five minutes in the first period of his game and it snapped halfway up again. I don’t think this is user intent, I believe and no, there’s definitely a manufacturing defect going on with these sticks. CCM quality has gone downhill. I understand if a stick breaks, because I’ve broken many because of play, this was a mere pass to another player in the sticks that.

The quality of the hockey products is quite poor. I purchased the CCM Jetspeed FT6 gloves, which CCM describes as elite-level protection designed to last for years, even in NHL play. However, after playing 20 recreational games, the fabric on the gloves has begun to come apart. If you are seeking high-quality hockey equipment, I would recommend exploring options other than CCM products.

ILLEGALLY TOOK OUT PAYMENT FOR A CANCELED ORDER
HORRIBLE CUSTOMER SERVICE, AND ILLEGALLY TOOK OUT PAYMENT
I had placed my first order with them, then was informed that the items were not in stock when calling about order status, so i CANCELED the order (but was later informed that they "didn't record the cancelation"). It didn't take out any payment since it was allegedly canceled, then 3 days after canceling the order they took out the payment ILLEGALLY and shipped the order without my permission. If i could give them negative stars i would, horrid customer service.
Company is an absolute joke
Company is an absolute joke, I am dealing with CCM Canada and they are terrible! They put a CCM Ribcor Trigger Pro junior stick on sale even though they had no stock. I told my son that I got him the stick for his birthday and it never showed up. After 3 weeks they refunded my money and said it was a computer glitch. They would rather piss off a bunch of Customers than try and do something for them. Never shopping CCM again!

10 Calls in - Still waiting for a refund on product that never arrived.
I have been dealing with this for 3 months now. I never received 7 out of the 9 products I ordered, for some reason the box ended up in New Jersey(I"m in Ontario) and no explanation as to why.
Every time I call it's like groundhog day. No one knows what I am talking about, no notes in the case file. It's gotten to the point where I recognize one of their customer service people's voice! Ridiculous customer service, never buying a CCM product ever again.
Do not order. Ever.

I bought my son a goalie helmet. The helmet cost almost $1000. After 1.5 months, the paint started to just peel off the helmet. The company said it was just cosmetics. At the moment, the helmet is getting worse and worse. The company simply stopped responding to my emails. Terrible service and terrible products. The company does not bear any responsibility for its products. You can tell from the helmet that it is a factory problem, but no one wants to be responsible for it. I will not buy their products anymore.

My son has bought a few CCM sticks over the years. For the price you would think they would last for awhile…not the case! The last one cost him $450 and he got 6 uses out of it (of course it broke shortly after the warranty period ended). It seems these sticks only have about 10 uses in them. no one answers the phone, no one replies to emails, messaged CEO today Marrouane Nabih to see if I can get any response but after seeing poor reviews EVERYWHERE and on his/her watch I'm not hopeful of any response. cancelled order due to not shipping on time and shipped anyways, shipped back (returned) and they have it and confirmed it was received a month ago. no refund to my CC yet and were going to send some swag for all the BS I went thru...that hasn't happened yet either (a good 2 weeks since that conversation.

We ordered a goalie blocker for my son on Nov 25 as a Christmas present. It is all he wanted. It never arrived, order always said pending. No updates or information, kept checking the site. We ending up wrapping up the confirmation email and he was excited for it to arrive soon. All the site said was" due to higher volume, expect delays of up to 10 business days". I was patient, trusted that they had a system in place. On January 2nd, I received an email back from my order inquiry stating "We wanted to let you know we are still working on your order and are doing our best to have it fulfilled! We thank you for your patients at this time!"
After a couple days I emailed back asking for an actual timeline as I had a child checking the door daily for his blocker.

No answer on phone
Finally spoke to someone on Jan 10th, it was forwarded to warranty. They said that CCM canceled my order a couple weeks ago and they don't have a system in place to inform customers of that. I asked to speak to a manager or someone with customer relations, he said that he will forward on my concern but I doubt I will hear back.
For a company of this size to not have a system for informing customers of cancelations is unacceptable. I will not support CCM anymore as they make it very clear, they do not care about their customers. Trying to purchase from CCM this year for Christmas was my biggest regret. My son only wanted CCM, he was so excited. We will bring him out this weekend to get his blocker from another brand. You lost a young supporter for life now.
Really bad after sales service
Really bad after sales service. They do not respond to emails or entries on their contact form on their website. They deliver partial order and leave you hanging with no details on the remaining items in the order. Leaving the customer to wonder if it is yet to be delivered or cancelled. My remaining order has been in the pending stage for 3 weeks with no movement and update.
