Small Claims Warning: Predetermination, Lack of Disability Accommodation, and Costs Ambush
I am sharing my recent experience as an unrepresented Litigant in Person at Manchester Civil Justice Centre (Small Claims Track) as a caution to others managing health conditions:
1. Lack of Adjustments: Despite managing ongoing medical conditions requiring heavy medication, no adjustments were made to ensure a manageable pace. The questioning was rapid and intimidating.
2. Predetermination on Narrow Contract Terms: The court fixated on a single booking confirmation detail, repeatedly cutting off my arguments under the Consumer Rights Act 2015 regarding front-desk operational negligence.
3. Corporate Hearsay over Eyewitness Testimony: The defendant had no witness statement from the key staff member involved (who had left their employ), yet this uncorroborated corporate position was preferred over sworn eyewitness testimony.
4. Costs Ambush: CPR 27.14 restricts small claims costs, but the defendant produced an unverified £432 expense sheet (including hotel and mileage for an afternoon hearing) at the final minute. The court awarded it instantaneously without examining receipts or allowing time to review the figures.
Takeaway for LIPs: Always formally request reasonable adjustments in writing well ahead of the hearing, demand to inspect original expense receipts if a schedule is handed over, and do not hesitate to ask for a recess if you are rushed.
